The Federal Government has directed all Ministries, Departments and Agencies (MDAs) to fully comply with the Nigeria Data Protection Act, 2023, as part of efforts to strengthen how citizens’ personal information is collected and protected across public institutions.
The directive is contained in Circular No. 59805/S.I/74, dated July 27, 2026, and signed by the Secretary to the Government of the Federation, Senator George Akume.
President Bola Tinubu described data as “the new oil,” saying its value increases the more it is refined and responsibly shared. He directed all MDAs to capture information rigorously while safeguarding it in line with the Act.
Under the circular, every MDA must appoint qualified Data Protection Officers who will be registered with the Nigeria Data Protection Commission (NDPC). Agencies may also engage licensed Data Protection Compliance Organisations to support audits and other statutory obligations.
MDAs are required to make budgetary provisions for staff training, public awareness, security technologies and regular compliance audits, and to submit mandatory Data Protection Compliance Audit Returns within timelines prescribed by law.
Permanent Secretaries, Accounting Officers and Chief Executive Officers of MDAs will be personally accountable for compliance with the circular and the Act.
NDPC National Commissioner and CEO, Dr. Vincent Olatunji, welcomed the directive, calling it a strong signal of the Federal Government’s commitment to protecting Nigerians’ privacy and fundamental freedoms. He said responsible data governance is indispensable to Nigeria’s pursuit of the eight Presidential Priorities and its digital economy agenda.
The NDPC has set up a regulatory clinic to provide technical guidance and support MDAs in meeting the new compliance requirements.
